Terms of Service for GEMxAPP

1. Acceptance of Terms
By creating an account on GEMxAPP, you agree to be bound by these Terms of Service (“ToS”) and any future updates or modifications. To create an account, users must complete a mobile phone check, email verification, and submit basic ID details such as name and location. Users must be at least 13 years old to create a membership account.

2. User Accounts
Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. GEMxAPP reserves the right to suspend or terminate accounts that violate these ToS or engage in any illegal activities.

3. User Conduct
Users must follow specific rules when using GEMxAPP, including no hate speech, no harassment, no illegal activities, and adhering to jurisdictional rules, as well as other standard boilerplate rules. Users found to be in violation of these rules will first receive a warning, then face suspension, and ultimately have their account terminated after multiple offenses.

4. Content

• Users can upload content such as images, graphics, embedded videos, and gifs on GEMxAPP.
• Users retain ownership of the content they upload.
• Sacred Space LLC (GEMxAPP) reserves the right to remove any content that violates the ToS or any applicable laws.
• Intellectual Property – Sacred Space LLC (GEMxAPP) claims IP rights on any content created by the company and published on the app.
• Users can use, reproduce, or share GEMxAPP’s content based on any stipulations listed in the ToS.

6. Third-Party Services
GEMxAPP integrates with various third-party services, including Twilio, SendGrid, Polygon Layer 2, Ethereum scaling solution, Hedera Hashgraph, Ory, Meeco, and Theta Labs. Users must adhere to the ToS of these third-party services and should reference them to ensure compliance with their rules.

7. Privacy Policy
Please take a look at our separate Privacy Policy for information on how we collect, use, store, and share your personal information. The Privacy Policy is incorporated into and made a part of these ToS.

8. Disclaimers
Plant Medicine therapy and medical information are presented only as informational resources and should not replace personalized medical consultations. The use of GEMxAPP is provided “as is” and “as available” without any warranties, express or implied.

9. Limitation of Liability
Sacred Space LLC (GEMxAPP) and its services will have limitations of liability for direct, indirect, and consequential damages.

10. Termination
Sacred Space LLC (GEMxAPP) can terminate a user’s account after repeated violations of the ToS. The process for handling rule violations includes warnings, suspensions, and potential termination after multiple suspensions.

11. Governing Law and Dispute Resolution
These ToS and any disputes arising from its use will be governed by the laws of Oklahoma. By using GEMxAPP, you agree to resolve any disputes through arbitration and Alternative Dispute Resolution (ADR) processes.

12. Changes to the ToS
GEMxAPP reserves the right to update or modify these ToS at any time. Users will receive in-app notifications about any updates or changes to the ToS. Users must accept
